The murky world of Conditional Access has been tracking the so-called “Spygate” trial in California with interest. The jury will start their deliberations tomorrow (May 13) at 8am.
Closing arguments in the Echostar and NagraStar case against N.D.S wrapped up last week. N.D.S’ attorneys countered the somewhat damaging allegations against them by arguing that all smart-card suppliers did much the same, and that Echostar had allegedly engaged in the exact same procedures in attempts to discover what the hackers were up to.
Echostar (along with NagraStar, its j-v with the Kudelski Group) are seeking damages and compensation that could top US$1bn in total. Echostar argues it should be awarded $181m because it was forced to pay $90m to replace its smart cards and lost another $90 million in profits. But the big number comes from the potential punitive damages which will perhaps boost the bill, should N.D.S lose, to beyond $1bn.
N.D.S is 80% owned by News Corp, although *** also has a cash reserve of some $700m in its accounts
